MALAYSIA:::Mahkamah tolak saman fitnah Maybank

KUALA LUMPUR - Malayan Banking Berhad (Maybank) hari ini kalah dalam kes saman fitnah terhadap Kesatuan Kebangsaan Pekerja-pekerja Bank (NUBE) dan setiausaha agungnya, J.Sandagran Solomon berhubung kenyataan berbaur fitnah terhadap syarikat itu yang disiarkan dalam laman web Nube.

Ketika menolak saman berkenaan, Hakim Mahkamah Tinggi Datuk Hue Siew Kheng memutuskan kesatuan sekerja itu dan pegawainya memiliki imuniti daripada disaman mengikut Seksyen 22 Akta Kesatuan Sekerja 1959.

"Defendan memiliki imuniti daripada disaman mengikut Seksyen 22 akta berkenaan," kata beliau dalam penghakiman ringkas.

MALAYSIA::: Maybank Loses Defamation Suit Against NUBE

MaybankKUALA LUMPUR, Dec 31 (Bernama) — The Malayan Banking Berhad (Maybank) on Wednesday lost in its suit against the National Union of Bank Employees (NUBE) and its general secretary J. Sandagran Solomon over defamatory statements on the company which were published on the NUBE website.
High Court Judge Datuk Hue Siew Kheng, when dismissing the suit, said, the trade union and its officers were immune from lawsuits as provided under Section 22 of the Trade Unions Act 1959.
“The defendants are immune from being sued under Section 22 of the act,” she said in her brief judgment and ordered Maybank to pay RM30,000 in costs to the two defendants.
She made the ruling after hearing evidence from two witnesses from the bank and a testimonial from Solomon.
NUBEOn Nov 24, 2011 the High Court had allowed NUBE’s application to strike out the suit. However, upon an appeal at the Court of Appeal in 2012, the bank succeeded in setting aside the High Court’s ruling and the suit went for a full trial.
Maybank filed the suit on April 22, 2011, claiming that Solomon, acting on his own behalf and NUBE, had in February or March, 2011 published articles containing defamatory statements of the company on the NUBE website.

Peruntukkan berkaitan dengan cuti bersalin dan faedah bersalin bagi pekerja wanita ada dinyatakan dalam Akta Kerja 1955 dan Peraturan berkaitan. Antara aspek penting yang wajib diketahui oleh pekerja dan majikan adalah Akta Kerja (Pindaan) 2012 ataupun Akta 1419 yang meminda Akta Kerja 1955 dan memasukkan seksyen baru iaitu Seksyen 44A yang menyatakan bahawa semua peruntukan bagi perlindungan bersalin (Bahagian IX) adalah terpakai kepada semua wanita tidak kira berapa gaji mereka.
Ini bermakna pekerja (di bawah ‘contract of service’) yang gaji nya melebihi RM 2,000 atau RM 5,000 sekalipun diberi perlindungan bersalin di bawah Akta Kerja 1955.

INDONESIA:::Airbus A320-200 Govt confirms debris from AirAsia

The Transportation Ministry’s acting director general of air transportation, Djoko Murjatmodjo, confirmed on Tuesday that wreckage discovered in Pangkalan Bun, Central Kalimantan, was from AirAsia flight QZ8501.
“It has been confirmed that it is debris from an aircraft bearing red and white colors,” Djoko said, citing that the debris was found by the ministry’s rescue team.
“The recovery process will now be centered in the debris location in coordination with Basarnas [the National Search and Rescue Agency],” he continued.
Flight QZ8501, en route to Singapore from Indonesia’s second-biggest city of Surabaya in East Java, was officially declared missing on Sunday morning.

Philippines:::$1-M US grant to bolster PH workers' rights

MANILA, Philippines - The United States government’s $1-million technical assistance grant to the International Labor Organization (ILO) will bolster the Philippines’ labor inspection capacity and workers’ rights.
US embassy spokesman Kurt Hoyer said the assistance would accelerate the country’s compliance with global labor standards.
The International Labor Affairs Bureau (ILAB) of the US Department of Labor announced the grant, which was awarded to the ILO for implementation.

Marine company's work pass privileges curbed for discriminating S'porean workers
The Ministry of Manpower (MOM) has curbed the work pass privileges of marine company Prime Gold International Pte Ltd (Prime Gold) for two years for engaging in discriminatory employment practices in breach of the Fair Consideration Framework (FCF).
Under the FCF, all firms must consider Singaporeans fairly for job vacancies. They should also put in place fair hiring, employment, and staff development practices that are open, merit-based and non-discriminatory.
This is the first time a company has been given such a ban, although MOM has previously taken action against 100 odd companies for posting discriminatory job advertisements.

By day, the area behind Safra Tampines seems typical of a cluster of industrial buildings.
The eight blocks of flatted factories at Tampines Industrial Park A comprise car workshops, furniture makers and warehouses.
Come nightfall, however, the place transforms into a secret dormitory for foreign workers.
Some 1,000 foreign workers sleep in these workshops and flatted factories, hidden behind partitions.
At night, streams of lorries unload workers at these illegal dormitories.
Some of the dorms are in units marked "under renovation".
One person who tipped off The New Paper thinks there are about 8,000 people sleeping in these eight blocks at night.
TNP spent two weeks staking out the place. Going by the number of buses ferrying in workers, there seemed to be about 1,000 workers staying there.

MALAYSIA:::Airlines, crew show solidarity

KUALA LUMPUR: Messages of hope poured in for those onboard missing Indonesia AirAsia Flight QZ8501 yesterday, notably from the airline crew who displayed solidarity with their missing brethren.
National carrier Malaysia Airlines, via its Facebook page, posted the message: “#staystrong AirAsia — Our thoughts and prayers are with all family and friends of those on board QZ8501.”
The National Union of Flight Attendants Malaysia (Nufam) also expressed support for the crew and passengers onboard the aircraft.
“Our prayers and heartfelt wishes go to the crew and passengers... let’s pray for the best,” Nufam posted on its Facebook page.
Association of Flight Attendants-CWA, the world’s largest flight attendant union, called on its members to pray for those on the aircraft.
On Facebook, British Airways (BA) flight attendant Luigi Enrico Faletti said he was hoping for the best. An Air France staff, Nicolas Baradel, wrote: “Love and Prayers to the AirAsia family from France and the Air France family. We are united by wings.”

Indonesian authorities in the Bangka Belitung province fear search and rescue efforts for missing AirAsia flight QZ8501 will be hampered by bad weather and big waves.
Indonesian news portal Kompas.com quoted National Search and Rescue Agency (Basarnas) Bangka Belitung spokesman Jhoni Supriadi in Pangkalpinang as saying that waves were as high as two metres, delaying the SAR team from reaching the location where they believe the plane had crashed.
It was earlier reported that the missing Airbus A320 was believed to have crashed at the location 03.22.46 South and 108.50.07 East, in waters around 80 to 100 nautical miles from Belitung while flying from Surabaya to Singapore this morning.

MALAYSIA:::Need to ensure workers’ safety on the road

AS the year draws to a close, I wish to call on employers and employees to look back and review their efforts in reducing commuting accidents on the roads.
While industrial accidents are generally on the decline, the number of commuting accidents involving employees has increased 25 per cent in the past three years, from 22,036 accidents with 1,194 deaths in 2010 to 27,659 accidents with 933 deaths last year, as reported by the Social Security Organisation (Socso). For the first seven months of this year, 16,203 commuting accidents with 566 deaths were reported.
While safety risks and resulting work accidents are manageable, work-related commuting accidents are on the rise.

LESS than four decades ago, when there were “no foreign workers around”, I had a noble job. It was mainly about holding a cangkul and sweating the whole day so that Malaysians across the country had vegetables on their plates.
As a farmhand in Cameron Highlands, I can assert that I have had a hand in nourishing my fellow countrymen, via the vitamins in the cabbages that I planted.
For a paltry salary of RM180 a month (with food and lodging provided), for six days a week, I planted cabbages, harvested and packed them into rattan baskets that were loaded onto lorries.

Pesawat AirAsia dilaporkan hilang dalam perjalanan dari Surabaya, Indonesia ke Singapura pagi ini setelah  dilaporkan terputus perhubungan dengan pusat kawalan udara.

An AirAsia flight travelling from the Indonesian city of Surabaya to Singapore has lost contact with air traffic control, the company has said.
Indonesian media say 162 people were on board.
The aircraft, flight number QZ8501, lost contact with air traffic control just after 07:00am local time, AirAsia tweeted.

Jakarta - Pesawat milik maskapai AirAsia dipastikan hilang kontak dengan menara ATC Bandara Internasional Juanda Surabaya pagi ini. Berdasarkan informasi, jumlah penumpang di pesawat rute Surabaya-Singapura itu yaitu 155 orang.

"Ya (informasi yang diterima sementara ini berjumlah 155 orang)," ujar Kapuskom Publik Kemenhub JA Barata saat dikonfirmasi detikcom, Minggu (28/12/2014).

Informasi menyebutkan, AirAsia bernomor AWQ 8501 berangkat pukul 05.20 WIB. Data sementara menunjukkan jumlah penumpang ada 155 orang yang terdiri dari 130 orang dewasa, 24 anak dan 1 bayi.

Pesawat diduga hilang di atas pulau Kalimantan. Pesawat diterbangkan oleh Kapten Irianto dengan kopilot Remi Imannuel.

SHAH ALAM -- The Malaysian Trades Union Congress (MTUC) has urged private sector employers in the flood-affected states to consider granting paid leave to their employees until the floodwaters recede.
MTUC deputy secretary-general A. Balasubramaniam said this was one way of easing the difficulties faced by workers due to the floods.
"Private sector employers should be lenient enough to grant paid leave for their employees at a time when the floods are ravaging many states.

PETALING JAYA: Two Bangladeshi workers were killed after they were trapped in wet concrete following the collapse of a floor being levelled at an LRT terminal construction site in Putra Heights near here yesterday.
The bodies of the workers were recovered from the collapsed wet concrete at 10.24pm yesterday and 1.10am today, said Selangor Fire and Rescue assistant director of operations Mohd Sani Harul.
He said the body recovered yesterday had been identified as that of Md Suman Mollah, in his 30s, while the body found today had yet to be identified.

EPF Deputy Chief Executive Officer of Operations, Mohd Naim Daruwish in a media statement here said the amount in arrears included contributions from August 2013 to September 2014.
“The EPF has completed investigations into PSSB Kemaman and there are civil suits which have not been settled by the management and directors of the company at the Kuala Terengganu High Court to get back the outstanding contributions.

Menurut Suruhanjaya Komunikasi dan Multimedia Malaysia (SKMM), SMS 'is this your photo' perlu dipadam kerana pautan yang diberi dalam SMS itu mengandungi malware.
Malware ialah perisian yang dicipta khusus untuk merosakkan sistem komputer.

Kegagalan memastikan keselamatan itu menyebabkan kematian orang awam dan kecederaan pekerja semasa kejadianruntuhanpenyambung Jambatan Sultan Abdul Halim Mu'adzam Shah pada Jun tahun lepas.

Hakim Sitarun Nisa Abdul Aziz memerintahkan Chan Kah Heen, 39, yang mewakili Cergas Murni Sdn Bhd membayar denda RM50,000, manakala Raub Razali, 50, pengarah Giga Engineering & Construction Sdn Bhd pula RM35,000.

Malaysia today deported nearly 500 undocumented Indonesian workers, in what analysts said was part of a push to clamp down on illegal labour as the economy starts to slow.
The workers were brought in shackles to the Subang Airport ,west of Kuala Lumpur, where Indonesian officials said they would be loaded onto military C-130 aircraft to be flown to their native country.
Another 200 will be deported tomorrow, Indonesia’s ambassador to Malaysia Herman Prayitno said, adding that more illegal workers may be sent back next year.

MALAYSIA:::EPF to sue Perwaja Steel

The Employees Provident Fund (EPF) has taken legal action against Perwaja Steel (Kemaman) Sdn Bhd (PSSB) for defaulting monthly EPF contributions, amounting to RM9.17 million, for the period between August 2013 and September 2014.
The action, both prosecution and civil suit, was also taken personally against company directors for the same default.

PERU:::New labor regime in Peru complies with ILO conventions


Peru's Minister of Foreign Trade and Tourism Magali Silva said the new labor regime complies with all the agreements signed with the International Labour Organization (ILO) and ruled it out as a violation of young people’s rights in Peru.

"As a minister of Foreign Trade and Tourism, it is my duty to ensure institutional arrangements across the country. This regulation has been implemented with all due respect to international agreements and accords inked between Peru and the ILO,” she pointed out.
