MALAYSIA:::Malaysian Trade Union Congress (MTUC) has handed over a Memorandum today to Malaysian Human Right Commission (Suhakam) based on a complaint against Former Minister of Human Resources


Malaysian Trade Union Congress (MTUC) has handed over a Memorandum today to Malaysian Human Right Commission (Suhakam) based on a complaint against Former Minister of Human Resources YB Dato Dr S Subramaniam for making false and fabricated statement at the International Labour Organisation.


The Memorandum was received by Commissioner YBhg. James Nayagam from the Chairman of the Action Committee of MTUC Sdr. Abdul Razak MD Hassan. 

The Chairman was accompanied by YB Abdullah Sani Chairman of the Parliamentary Labour Caucus with the members of the MTUC Action committee and NUBE.

From the turn of events, we believe that Dr. S Subramaniam had prior knowledge of the High Court decision made against NUBE on 7 November 2013, two (2) years ago.

At the International Labour Organisation’s Committee of Experts on Freedom of Association, Subramaniam told that NUBE had challenged the registration of the Maybank In-House Union in the High Court and that the High Court had decided the Director General of Trades Union’s (DGTU) decision to register the Maybank in-house union is valid and within the powers of DGTU.

Abdul Razak said this in responding to the complaint submitted by the Malaysian Trade Union Congress (MTUC) against the DGTU for registering overlapping unions.

Almost two (2) years later, on November 7, 2013 the High Court handed that very same decision and dismissed the case filed by National Union of Banking Employees (NUBE) challenging the registration of an in-house union in Maybank.

NUBE, a national union has executed 16 Collective Agreements with MCBA, a trade union of employers the representing the 26 commercial banks including Maybank. The 16th Collective Agreement imposes the condition for MCBA and its member Banks to recognize NUBE as the sole negotiating body in respect of the employees”.

MTUC is shocked and the question raised is; how did the Minister of Human Resources report to the ILO a decision of the High Court two (2) years prior to the actual High Court judgment on 7 November 2013?

We urge the government to conduct an urgent investigation on this discrepancy to protect the image and reputation of the Malaysian Government and institute disciplinary action against the Minister for the false and misrepresenting statement made at the International platform on behalf of the Malaysian Government

Pada mesyuarat Jawatankuasa Pakar Kebebasan Persatuan Pertubuhan Buruh Antarabangsa , Subramaniam telah memberitahu bahawa NUBE telah mencabar pendaftaran Maybank 'In-House Union' di Mahkamah Tinggi dan Mahkamah Tinggi telah memutuskan bahawa keputusan Ketua Pengarah Kesatuan Sekerja (DGTU ) untuk mendaftar Maybank di-rumah kesatuan adalah sah dan berada dalam bidang kuasa DGTU.
 
Abdul Razak berkata sedemikian dalam respons kepada aduan yang dikemukakan oleh Kongres Kesatuan Sekerja Malaysia ( MTUC ) terhadap DGTU untuk mendaftar bertindih kesatuan.
 
Hampir dua (2) tahun kemudian, pada 7 November 2013, Mahkamah Tinggi telah memberi keputusan yang sama dan menolak kes yang difailkan oleh Kesatuan Kebangsaan Pekerja-Pekerja Bank (NUBE) yang mencabar pendaftaran 'In-House Union' di Maybank.
 
NUBE sebagai kesatuan peringkat kebangsaan telah melaksanakan 16 Perjanjian Kolektif dengan MCBA  kesatuan sekerja majikan yang mewakili 26 bank perdagangan termasuk Maybank. Perjanjian Kolektif yang ke 16 mengenakan syarat untuk MCBA dan bank-bank ahli untuk mengiktiraf NUBE sebagai badan rundingan tunggal untuk pekerja " .
 
MTUC terkejut dan membangkitkan persoalan bagaimana Menteri Sumber Manusia melaporkan kepada ILO keputusan Mahkamah Tinggi dua (2) tahun sebelum penghakimannya pada 7 November 2013 di Mahkamah Tinggi ?
 
Kami menggesa kerajaan untuk menjalankan siasatan segera bagi isu ini untuk menjaga imej dan reputasi Kerajaan Malaysia dan memulakan tindakan tatatertib terhadap Menteri yang telah memberi kenyataan palsu dan memberikan gambaran yang salah bagi pihak Kerajaan Malaysia di platform antarabangsa.
