MALAYSIA:::PRINSIP PERLINDUNGAN KESELAMATAN SOSIAL

PERKESO telah diamanahkan untuk melaksanakan atau menguatkuasakan Akta Keselamatan Sosial Pekerja 1969 dan Peraturan-Peraturan (Am) Sosial Pekerja 1971. Melalui Akta dan Peraturan, PERKESO memberi jaminan rawatan perubatan percuma, kemudahan pemulihan jasmani atau vokasional serta faedah kewangan kepada pekerja sekiranya mereka mengalami hilangupaya akibat dari kemalangan ataupun mengidap penyakit yang menyebabkan mereka kekurangan upaya untuk bekerja ataupun tidak upaya langsung untuk bekerja lagi. Sekiranya pekerja meninggal dunia, orang tanggungan mereka diberi jaminan kewangan dengan menerima pencen bulanan bagi meneruskan kehidupan.

UMNO Bahagian Serdang mendakwa salah urus punca Utusan Printcorp membuang 104 pekerjanya baru-baru ini. Selain dibuang tanpa notis, kesemua mereka juga sudah tidak dibayar gaji selama tiga bulan sejak Ogos lalu.

Ahli Parlimen Kuala Langat, Abdullah Sani Abdul Hamid hari ini membidas beberapa majikan termasuk syarikat berkaitan kerajaan yang memecat pekerjaan tanpa mengikut undang-undang.

Beliau yang juga adalah Timbalan Presiden Kongres Kesatuan Sekerja Malaysia (MTUC) antara lain menamakan syarikat Keretapi Tanah Melayu Berhad (KTMB), Malaysian Airlines (MAS) dan Maybank.

MALAYSIA:::The foreign labour dilemma


The announcement by Minister of Human Resources Dato Sri Richard Riot Jaem that the state would be recruiting 12,000 workers from Bangladesh has sparked a mixed reaction of alarm and relief.
Their imminent arrival raised fears they would deprive locals of job opportunities and their presence could spawn social problems.
The first concern was addressed by Riot’s assurance that the Bangladeshis would only be working in the plantation sector where they would take jobs shunned by locals.

Some of the 167 workers picketing to protest the failure of their employer to contribute to the Employees Provident Fund.
The Employees Provident Fund (EPF) said its investigation revealed that Recycle Energy Sdn Bhd had defaulted in its EPF contributions between 2012 and 2014.
EPF head of corporate affairs Nik Affendi Jaafar, in a statement, said two civil suits had also been filed against the employer and its company directors.

MTUC: PROBE COMPANIES' MISCONDUCT

The Malaysian Trade Union Congress, MTUC has submitted a memorandum to the Bar Council and the Malaysian Human Rights Commission, SUHAKAM, over alleged mistreatment of union members by certain companies.
MTUC wants the two institutions to investigate complaints of misconduct levelled at several companies, including suppressing union members.
The memorandum was handed over during a peaceful gathering in front of the  Bar Council and also at the SUHAKAM office.
About 150 members and leaders from various unions were present.
MTUC Secretary General, Gopal Krishnam said the unions understand the employers' needs, but they must not interfere with union's business unless they broke the law.
National Union of Flight Attendants Malaysia, NUFAM former president Ismail Nasaruddin, who was recently sacked by Malaysia Airlines, said they wanted their rights to be protected.
According to the MTUC, more than 100 workers from several companies have been fired and suspended for trivial reasons.

Amnesty slams ‘abuse’ of migrant workers in South Korea

SEOUL: Migrant farm workers in South Korea have become victims of rampant abuse under a “shameful” work permit system that encourages exploitation, Amnesty International said in a report published Monday.
The report came on the heels of a mission to South Korea by the UN’s special rapporteur on racism, who also cited “serious problems” faced by the growing number of foreign workers hired as low-paid, unskilled manual labourers.

ILO: Weak Employment Growth Depressing Consumption

Weak employment growth, stagnant wages and widening inequality are depressing consumption and deterring investment in many countries, the International Labour Organisation (ILO) has said.
The international labour body, in a statement to the International Monetary and Financial Committee of the World Bank, noted that the slow growth of the global economy in recent years showed signs of becoming a persistent low growth trap.
The organisation observed that growth in the global economy is slowing in 2014, adding that even the forecasts of slight improvement in 2015 are beset with uncertainty.

They fear that in certain factories, labour relations would go out of control if union leaders are democratically elected. Generally speaking, there are three types of factories that are not suitable for democratic election: first, factories that have tense labour relations. Workers at this kind of factories are likely to elect radical leaders as union chairman, who will not be helpful in stabilising labour relations.

KEPALA BATAS - Setiap seorang daripada 100 rakyat Malaysia dikesan menghidap penyakit mental, skizofrenia, kata Timbalan Menteri Kesihatan Datuk Seri Dr Hilmi Yahaya.
   
Beliau berkata, situasi itu membimbangkan kerana pesakit skizofrenia boleh bertindak mencederakan diri sendiri dan orang lain.
   
"Semakin ramai rakyat Malaysia menghidap skizofrenia kerana pesakit dan masyarakat sekeliling tidak memandang serius masalah berkenaan selain enggan mendapatkan rawatan.
   
"Masalah kesihatan mental terutama penghidap skizofrenia tidak boleh dipandang ringan kerana jika tidak dirawat, mereka boleh bertindak mencederakan orang lain, ini sangat berbahaya," katanya kepada pemberita selepas merasmikan Kem I Want Sihat (KIS) sempena sambutan Hari Kesihatan Mental Sedunia 2014 di sini, hari ini.

MEMORANDUM UNTUK MENGHENTIKAN SEGALA BENTUK MEMECAH BELAHKAN KESATUAN ‘UNION BUSTING’ DAN PELANGGARAN HAK ASASI PEKERJA
'Union Busting'merupakan satu trend yang semakin ketara di mana majikan memberhentikan, menamatkan, memecat, menggantung dan mengambil tindakan disiplin terhadap pemimpin-pemimpin kesatuan sekerja dan ahli-ahli serta pekerja-pekerja yang terlibat dalam aktiviti kesatuan sekerja yang dianjurkan secara sah. Antaranya:
1. Pekerja-pekerja yang berpiket di hadapan bangunan Keretapi Tanah Melayu Berhad (KTMB) bagi menuntut hak kebajikan dan hak-hak masa dalam satu piket telah dikenakan tindakan disiplin. Presiden KTMB telah memecat Presiden Kesatuan pekerja-pekerjaKeretapi Tanah Melayu (RUM-Abdul Razak Md Hassan), dan Naib Presiden-R. Subramaniam bersamaan dengan 41 pekerja lain dan 27 orang lagi digantung dari kerja kerana mengambil bahagian dalam piket tersebut.
2. Manakala Presiden Kesatuan Kebangsaan Penerbangan Atendan Malaysia (NUFAM)Ismail Nasaruddin telah dipecat oleh Malaysia Airlines System Berhad (MAS) kerana telah mengeluarkan kenyataan media. Beliau telah dihentikan dengan alasan bahawa ia adalah salah laku bagi seseorang pekerja untuk mengeluarkan Pernyataan tersebut. Setiausaha Agungnya-Mohd Akram Osman bersama lima ahli kesatuan lain juga telah ditamatkan perkhidmatan kerana terlibat dalam aktiviti kesatuan.
3. Naib Presiden NUBE-Abdul Jamil Jalaludeen dan bendaharinya-Chen Ka Fatt telah ditamatkan perkhidmatan atas alasan terlibat dalam aktiviti kesatuan oleh pihak pengurusan bank.
4. Seterusnya RENESAS telah memecat Wan Noorulazhar bin Mohd Hanafiah, Presiden Kesatuan Pekerja-pekerja Industri Elektronik Wilayah Barat, Semenanjung Malaysia (EIEUWR),kerana menyuarakan dan membangkitkan hak-hak pekerjaserta ketidakadilan pekerja dalam kumpulan Facebook tertutup kesatuan.
5. Seterusnya penyerahan memorandum Kongres Kesatuan Sekerja Malaysia (MTUC) kepada calon yang akan bertanding dalam Pilihan raya Umum bagi mendapatkan sokongan terhadap hak-hak pekerja, 18 anggota kesatuan dari Kesatuan Kebangsaan Pekerja-Pekerja Perusahaan Alat-alat Pengangkutan dan Sekutu (NUTEAIW) telah dipecat oleh anak syarikat DRB HICOM di Pekan, Pahang termasuk Pengerusi Bahagian MTUC Pahang Sdra. Rusaini Ramli telah dipecat.
6. PresidenKesatuan KebangsaanWartawan(NUJ), Mohamed HattaWahari, Timbalan Presiden, KetuaCawanganAmranAhmaddan Timbalan SetiausahaNorazriAbdulRahmantelah dipecat oleh Utusan Melayu(M) Bhd bagi mengeluarkan kenyataanmedia.
7.Presiden kesatuan, 17pemimpin kesatuan dan pekerja-pekerja dari Kesatuan Kakitangan
Pekerja-Pekerja Pelabuhan Barat telah dipecat oleh majikan kerana melibatkan diri dalam aktiviti kesatuan.
8. Bagi melakukan piketdi hadapanSyarikat AnselNP Melaka, yang menuntut hak kebajikan pekerja, Majikan SyarikatAnsel NP telah memecat Timbalan PengerusiCawangan (NUECMRP) dan 9 ahli kesatuan yang mengambil bahagian dalam piket tersebut.
9. Presiden dan Setiausaha Kesatuan Pekerja-pekerja Trinekiens telah dipecat bagi mengeluarkan pekeliling kesatuan untuk boikot Sambutan Hari Keluarga.
Senarai-senarai diatas adalah beberapa kes di manapekerja telah dipecat dan diambil tindakan disiplin oleh majikan-majikan mereka kerana penglibatan mereka dalam aktiviti-aktiviti kesatuan.
Akta Perhubungan Perusahaan 1967, seksyen 5 memperjelaskan bahawa:
The Industrial Relations Act 1967, section 5 - Prohibition on employers and their trade unions in respect of certain acts’ provides that ‘…(1) No employer or trade union of employers, and no person action on behalf of an employer or such trade union shall-(a) impose any condition in a contract of employment seeking to restrain the right of a person who is a party to the contract to join a trade union, or to continue his membership in a trade union;(b) refuse to employ any person on the ground that he is or is not a member or an officer of a trade union;(c) discriminate against any person in regard to employment, promotion, any condition of employment or working conditions on the ground that he is or is not a member or officer of a trade union;(d) dismiss or threaten to dismiss a workman, injure or threaten to injure him in his employment or alter or threaten to alter his position to his prejudice by reason that the workman- (i) is or proposes to become, or seeks to persuade any other person to become, a member or officer of a trade union; or (ii) participates in the promotion, formation or activities of a trade union; or (e) induce a person to refrain from becoming or to cease to be a member or officer of a trade union by conferring or offering to confer any advantage on or by procuring or offering to procure any advantage for any person…
.’Peruntukan ini kini memberi perlindungan terhadap pemecatan, tindakan disiplindan / atau diskriminasi terhadapahli kesatuan tetapi didapati masih tidak memadai.
Kerajaan sering melaungkan keharmonian industri, dan mempromosikan penggunaan mekanisme aduan tetapi ketidakadilan sering berlaku keranapeniaga-peniaga dan majikan terusmementingkan keuntungan,manakala pekerja-pekerja diberhentikan dibiarkan merana tanpa pekerjaan dan pendapatan yang menjejaskan kebajikandan kesejahteraan pekerja dan keluarga mereka.Proses bagi menyelesaikan kes pemberhentian mengambil waktu bertahun-tahun untuk diselesaikan dan ramai dikalangan mereka tidak dapat kembali ke jawatan mereka pada peringkat akhir penyelesaian.
Pendaftaran kesatuan dan pengiktirafan mengambil masa terlalu lama, apatah lagi majikan membuat permohonan bagi semakkan kehakiman dan rayuan kepada mahkamah. Kelewatan ini, tertangguh bertahun-tahun dan sekaligus menafikan hak pekerja dari tertakluk kepada fungsi penuh KESATUAN SEKERJA dan memperolehi manfaat dari Perjanjian Bersama.
Apa yang paling membimbangkan ialah beberapa tindakan 'union busting' sedang dilakukan oleh syarikat-syarikat milik kerajaan Malaysia atau syarikat yang ada hubungkait seperti KTMB, MAS, WESPORT dan DRB-HICOM.
OLEH YANG DEMIKIAN,KAMI MENYERU SUHAKAM, MAJLIS PEGUAM NEGARA DAN SEMUAKUMPULANHAK ASASI MANUSIA BERGABUNGBERSAMA BAGI MENYERU KERAJAAN MALAYSIA UNTUK : -
1. Mengakhiri segala bentuk aktiviti union busting, dan menghormati serta promosi hak-hak asasi pekerja;
2. Memperkenalkan lebih undang-undang yang lebih berkesan yang akan menghalang majikan dari melakukan 'union busting', memecat atau mengambil tindakan disiplin terhadap pemimpin-pemimpin kesatuan dan ahli kesatuan yang menyertai kegiatan kesatuan. Majikan harus menghentikan tindakan mengambil tindakan undang-undang dan disiplin terhadap pemimpin dan ahli kesatuan yang melakukan aktiviti-aktiviti kesatuan, mempromosikan hak-hak pekerja, dan berjuang menegakkan ketidakadilan di tempat kerja;
3. Salah laku Pekerjaan perlu secara tegas dihadkan kepada salah laku yang berkaitan dengan tempat kerja, dan bukannya menghalang kegiatan kesatuan dan pekerja yang menuntut hak serta menegakkkan ketidakadilan atau mempromosikan hak asasi pekerja;
4. Memulihkan dan mengambil semula kerja semua pemimpin kesatuan dan anggota yang telah dipecat, ditamatkan kerja, dihentikan, digantung kerja dan dikenakan tindakan disiplin kerana terlibat dalam aktiviti kesatuan;
5. Mempercepatkan proses pendaftaran dan pengiktirafan kesatuan sekerja;
6. Mempercepatkan proses menyelesaikan pertikaian perhubungan perusahaan dan kes-kes pemberhentian kerja serta salahlaku;
7. Menamatkan segala bentuk kegiatan UNION BUSTING.

The Social Security Scheme is operated according to the Social Security Act B.
E 2533 (A.D. 1990) and its Amendment .E. 2537 (A.D. 1994) and B.E. 2542 (A.D.
1999). The Office is responsible to provide financial assistance to its members
during the occurrence of sickness, maternity, invalidity, old age and unemployment,
death, the provision of medical care and the provision of child allowance.

MALAYSIA:::Factory goes bust, 500 migrants abandoned


More than 500 factory migrant workers are now in a limbo because the factory that hired them has gone bankrupt and the owners are allegedly holding to their passports.
 
Johor Malaysian Trade Union Congress (MTUC) secretary Mohanandas Krishnan said that the furniture factory in Ledang, closed its operations on Oct 1, without any prior notice to the workers.

ILO:::ASEAN integration to increase demand for workers – ILO-ADB study


Demand for high and low-skilled workers could increase by about 60 percent when ASEAN integration takes effect next year, a joint study by the International Labor Organization (ILO) and Asian Development Bank (ADB) concluded.

“The AEC (ASEAN Economic Community) will have major benefits for the Philippines. However, to maximize these benefits, the government must take decisive actions now, especially in terms of labor and employment as too many workers are still in poor quality jobs,” Sukti Dasgupta, chief of the ILO Regional Economic and Social Analysis Unit, said at the ILO-ADB ASEAN integration forum.

Some seven million private sector workers who earn less than RM3,000 a month are no better off under Budget 2015 as it does not adequately address their financial concerns, the Malaysian Trade Union Congress said today.
Expressing disappointment with the budget proposals tabled by the prime minister yesterday, its secretary-general N.Gopal Kishnam said the umbrella body for trade unions had expected Datuk Seri Najib Razak to advise private sector employers to pay monthly cost of living allowance to workers.
"It was done in the 1970s when Najib's father Tun Abdul Razak was the prime minister and later, employers absorbed the allowance as part of the salary package,"
