TS Solartech di Bukit Minyak buang 241 pekerja. / Another wave of retrenchments hits Penang manufacturing sector.

Pekerja TS Solartech, Bukit Minyak diberhentikan kerja serta merta dgn notis 24 jam. Seramai 241 orang terlibat tanpa diberitahu lebih awal, mungkin kilang akan ditutup.

Para pekerja terlibat telah menghubungi MTUC PENANG DIV. dan secara kebetulan pemangku Presiden MTUC Dato Abdullah Sani yang juga ahli parlimen Kuala Langat berada di Seberang Prai atas urusan MTUC dan seterusnya kepimpinan MTUC PENANG DIV bersama pemangku Presiden MTUC telah berjumpa pekerja pekerja terlibat di sebuah restoran di batu kawan,

MTUC juga telah menasihatkan pekerja terlibat untuk file kes di bawah akta perhubungan perusahaan sek 20, iaitu pemulihan pekerjaan, dan MTUC akan terus memantau serta membantu pekerja pekerja terlibat sehingga kes selesai, YB Dato Presiden juga akan membawa kes ini ke parlimen pada persidangan akan datang.

Another wave of retrenchments hits Penang manufacturing sector

Another wave of retrenchments has apparently hit Penang’s manufacturing sector, with a sudden announcement to over 200 employees that they are out of jobs. Business Times has obtained a memo purportedly sent out this afternoon by TS Solartech Sdn Bhd - a subsidiary of Tek Seng Holdings Bhd - that some of its employees will be out of work as early as tomorrow. TS Solartech is a mainland Penang-based crystalline silicon solar cell maker in which Taiwan-based Solartech Energy holds a 42 per cent stake. The memo dated today, and signed by two of the company’s officials named Choo Pei Ting and Lim Li Ming respectively, is titled `Retrenchment Programme.’ “We regret to inform you that due to redundancy of productivity, there will be a retrenchment programme for surplus workers,” the memo stated and referred to a list of affected workers which was reportedly attached to the document. “It does not involve those staff who have tendered their resignation and resigned before this memo was released. However, this decision is a not a reflection on your performance,” it added. The selected staff were instructed in the memo that tomorrow would be their last day at work and to present themselves to the company’s human resources department to collect their letters of indemnity and letters of retrenchment on Wednesday. Those affected were also advised they were not to present themselves for work tomorrow. Company officials could not be reached for comment. Two weeks ago, US-based Rubicon Technology Inc announced that it is closing down its facility - Rubicon Sapphire Technology (M) Sdn Bhd - on mainland Penang. It is learnt that some 180 people will be jobless owing to the closure by the end of this year. In July, it was reported that American hard disk maker Seagate Technology Plc and computer data storage firm Western Digital Corp (WD), would be relocating the bulk of their operations to Thailand. Seagate's Penang facility is said to have over 3,000 Malaysian staff, while WD was expected to lay off 400 Malaysian staff and 800 foreign workers from its Penang manufacturing site. Earlier this year, the world's biggest chipmaker Intel Technology, had announced that it would lay off up to 12,000 workers globally. Business Times has learnt the exercise in Malaysia has so far seen around 1,000 employees in Penang and Kulim in Kedah part ways with Intel.

Lagi pemberhentian pekerja dalam sektor pembuatan Pulau Pinang

Kira-kira 200 pekerja di kilang menghasilkan sel solar silikon kristal yang berpangkalan di Pulau Pinang bakal kehilangan mata pencarian mereka dengan gelombang terbaru pemberhentian pekerja melanda sektor pembuatan.
Menurut Business Times, firma TS Solartech Sdn Bhd - sebuah anak syarikat Tek Seng Holdings Bhd - mengeluarkan memo memaklumkan sebahagian pekerjanya akan diberhentikan seawal esok.
Solartech Energy di Taiwan memegang peratus kepentingan 42 peratus dalam syarikat itu.
"Dukacita dimaklumkan berikutan lebihan produktiviti, akan ada program pemberhentian pekerja,” petik memo yang dihantar kepada pekerja itu.
"Keputusan ini tidak mencerminkan prestasi anda.”
Sebelum ini, syarikat Rubicon Technology Inc yang berpangkalan di Amerika Syarikat memaklumkan ia akan menutup kilang Rubicon Sapphire Technology di Pulau Pinang, yang memberi kesan kepada 180 orang pekerja.
Pembuat cakera keras US Seagate Technology Plc, yang menggaji 3,000 kakitangan Malaysia, dan syarikat penyimpanan data komputer Western Digital Corp juga memindahkan sebahagian besar operasinya ke Thailand.
Western Digital dijangka memberhentikan 400 rakyat Malaysia dan 800 pekerja asing dari kilangnya di Pulau Pinang, lapor Business Times.
Intel Technology, yang mempunyai kilang di Pulau Pinang dan Kulim, Kedah, sedang memberhentikan 12,000 pekerjanya di seluruh dunia. Kira-kira 1,000 dari mereka adalah dari operasi di Malaysia.

Malaysian Trades Union Congress (MTUC) hope that the Federal Government will introduce better scheme in the Budget 2017, scheduled to be presented in Parliament next month, to ease the burden of new house buyers.

We still hears about the difficulties experienced by the rakyat to own a house. A comprehensive approach should be introduced to overcome the difficulties of getting house in the long term.
We have to admit that difficulties have worsened after the government introduced GST in April 2015. As such, MTUC hope that facilities that can ease the burden of buyers would be introduced in the 2017 Budget. We do not deny some incentives have been introduced in Budget 2016, but we are in a view that steps were not enough. The increase in the cost of living also complicates the opportunity to buy a house.
We know that the market price is not just determined by the demand, to some extent it is also determined by the real estate agents. This is a real situation. This situation has persisted for quite some time, where buyers at times falling victim to ruthless real estate agents. Housing, especially landed property in main towns, is only affordable to those with a five-figure monthly salary or more. Others can only look at and dream of owning one. This the dilemma we are facing today.

Salam Aidil Adha / Eid al-Adha

Eid al-Adha (Arabicعيد الأضحى‎‎ ʿīd al-aḍḥā[ʕiːd ælˈʔɑdˤħæː], "Festival of the Sacrifice"), also called the "Sacrifice Feast" or "Bakr-Eid", is the second of two Muslim holidays celebrated worldwide each year, and considered the holier of the two. It honors the willingness ofIbrahim (Abraham) to sacrifice his son, as an act of submission to God's command, before God then intervened sending his angel Jibra'il (Gabriel) and informs him that his sacrifice has already been accepted. The meat from the sacrificed animal is preferred to be divided into three parts. The family retains one third of the share; another third is given to relatives, friends and neighbors; and the remaining third is given to the poor and needy.
In the Islamic lunar calendarEid al-Adha falls on the 10th day of Dhu al-Hijjah and lasts for four days until the 13th day.[4] In the international (Gregorian) calendar, the dates vary from year to year drifting approximately 11 days earlier each year.
Eid al-Adha is the latter of the two Eid holidays, the former being Eid al-Fitr. The word "Eid" appears once in Al-Ma'ida, the fifth sura of the Quran, with the meaning "solemn festival".[5]
Like Eid al-Fitr, Eid al-Adha begins with asunnah prayer of two rakats followed by a sermon (khutbah). Eid al-Adha celebrations start after the descent of the Hujjaj, the pilgrims performing the Hajj, from Mount Arafat , a hill east of Mecca. Eid sacrifice may take place until sunset on the 13th day of Dhu al-Hijjah.[6] The days of Eid have been singled out in the Hadith as "days of remembrance" and considered the holiest days in the Islamic Calendar. The takbir (days) of Tashriq are from the Maghrib prayer of the 29th of Dhul-Qadah up to the Maghrib prayer of the 13th of Dhu al-Hijjah (thirteen days and nights) [7]

MALAYSIA:::EPF records RM8.44b income for Q2 2016

 Kumpulan Wang Simpanan Pekerja (KWSP) melaporkan pendapatan pelaburan suku tahunan sebanyak RM8.44 bilion bagi suku kedua (Q2 2016) berakhir 30 Jun, 2016, penurunan tahun ke tahun sebanyak 26.04 peratus berbanding RM11.41 bilion pada suku kedua 2015.
Aset pelaburan mencatatkan peningkatan sebanyak 0.76 peratus atau RM5.17 bilion, kepada RM689.69 bilion berbanding RM684.52 bilion pada 31 Dis, 2015.

MALAYSIA:::Proton Perbaharui Perjanjian Kolektif Dengan Kesatuan

KUALA LUMPUR: Proton Holdings Bhd memperbaharu  perjanjian kolektifnya (CA) dengan anggota kesatuan pada 19 Ogos bagi menggantikan perjanjian yang luput pada Disember tahun lepas.
Proton berkata CA berkenaan menawarkan penambahbaikan tertentu kepada pekerja, termasuk jajaran dengan arahan gaji minimum baharu, insurans majikan ke atas kemalangan peribadi, hayat, insurans perubatan dan manfaat kematian.


Adalah menjadi undang-undang yang kukuh bahawa seseorang pekerja dalam percubaan tidak mempunyai hak substantif untuk memegang jawatan yang dipegang itu ataupun memegang lien atas jawatan tersebut selepas tamat tempoh percubaan kontraktual yang telah dipersetujui oleh kedua-dua pihak. 
Apabila tempoh percubaan tersebut tamat, maka terpulanglah kepada Pihak majikan sama ada untuk mengesahkan perkhidmatan pekerja dalam percubaan tersebut atau sebaliknya.
 Undang-undang adalah mantap iaitu pekerja dalam percubaan tidak mempunyai hak untuk disahkan dalam jawatan mereka.
 Sekiranya majikan berpuashati dengan munasabah bahawa seseorang pekerja dalam percubaan tersebut tidak sesuai dengan jawatan itu, maka majikan boleh tidak mengesahkan pekerja itu. 
Rujuk kes Equitorial Timber Moulding Sdn. Bhd. v. John Micheal Crosskey, Kuching [1986] 2 ILR 1666, dan Vikay Technology Sdn. Bhd. v. Ang Seng Sew [1993] 1 ILR 90. 
Lord Denning dalam kes Alidair v. Taylor [1993] ICR 445 telah memutuskan majikan tidak perlu membuktikan seseorang pekerja dalam percubaan itu tidak mampu atau tidak cekap untuk menjalankan tugasnya, sebaliknya adalah mencukupi sekiranya majikan mempercayai atas alasan-alasan yang munasabah bahawa pekerja tersebut tidak mampu atau tidak cekap dalam menjalankan tugasnya.
Walau bagaimanapun hak majikan untuk menamatkan pekerja dalam percubaan perlulah dilaksanakan dengan good faith kerana hak seseorang pekerja yang masih dalam percubaan adalah sama dengan hak yang dimiliki oleh pekerja tetap. Oleh itu perkhidmatan mereka tidak boleh ditamatkan tanpa sebarang sebab atau alasan yang adil. 
Ini adalah  seperti yang diputuskan dalam kes Khalilah Abbas v. Pesaka Capital Corporation Sdn. Bhd. [1997]3 CLJ 827 iaitu:
 “The requirement of bona fide is essential in the dismissal of an employee on probation but if the dismissal or termination is found to be colourable exercise of the power to dismiss or as a result of discrimination or unfair labour practice, the Industrial Court has the jurisdiction to interfere and to set aside such dismissal.”
Sementara itu CP Mills dalam Industrial Disputes Law in Malaysia, 2 nd. Edition di mukasurat 11 telah menyatakan seperti berikut:
 “The IC has held that employment of a person on probation does not give the employer a right to terminate the contract at his absolute discretion. Even at common law, the employer’s right to determine the contract during the probationary period depended on the employer being reasonably satisfied as to the unsuitability of the employee. That is to say, the employer’s decision should be made bona fide, not arbitrarily or capriciously.”
 . Dalam kes Equitorial Timber Moulding Sdn. Bhd. Kuching v. John Micheal Crosskey [1986] 2 ILR 855 Mahkamah Perusahaan telah menyatakan prinsip-prinsip seperti berikut:
“Being a probationer, he has no substantive right to hold the post. He holds no lien on the post. He is on trial to prove his fitness for the post for which he offers his services. His character, suitability and capacity as an employee is to be tested during the probationary period and his employment on probation comes to an end if during or at the end of probationary period he is found to be unsuitable and his employer can terminate his probation by virtue or otherwise as provided in the terms of appointment.”
Kesesuaian seseorang pekerja itu bukan hanya bergantung kepada presatsi kerja pekerja itu sahaja, sebaliknya ia juga bergantung kepada kelakuan, tingkahlaku, aptitude dan sikap pekerja itu berkaitan dengan pekerjaan dimana pekerja tersebut diambil bekerja. 
Ujian sebenarnya adalah sama ada pekerja dalam percubaan itu mempunyai skil yang betul, kecekapan, perangai/tabiat, aptitude dan kesesuaian yang akan membolehkan beliau disahkan dalam jawatannya. Oleh itu orang yang paling sesuai untuk membuat penilaian keatas pekerja dalam percubaan ini atas keperluan-keperluan yang dinyatakan diatas sudah tentulah majikan itu sendiri.
Sekiranya seseorang pekerja dalam percubaan itu didapati mempamerkan prestasi kerja yang tidak memuaskan, adalah menjadi tugas Mahkamah untuk meneliti sama ada pekerja tersebut telah diberi amaran terlebih dahulu atau dimaklumkan berkaitan dengan kekurangan beliau dan sama ada walaupun amaran-amaran telah diberikan, pekerja tersebut masih gagal untuk melaksanakan kerja beliau sepertimana yang dikehendaki oleh majikan.
Dalam kes Kedah Marble Sdn. Bhd. v. Jaafar Mohamed [2000] 1 ILR 794 telah diputuskan seperti berikut:
 “As far as poor performance is concerned, the Industrial Court has set down that in order to justify the dismissal of the Claimant on this ground, the Company has to establish: i. that the Claimant was warned about his performance; ii. that the Claimant was accorded sufficient opportunity to improve; and iii. that notwithstanding the above the Claimant failed to sufficiently improve his performance.”

MALAYSIA:::Minister backs MTUC’s call for six-hour work day for civil servants

KUALA LUMPUR, Sept 5 — A federal minister has supported the proposal for government employees to work just six hours daily, saying this would benefit their families.
According to Utusan Malaysia, Women, Family and Community Development Minister Datuk Seri Rohani Abdul Karim approved of the idea initially proposed by the Malayan Trade Unions Congress (MTUC).
“However, my ministry cannot be alone in trying to realise the suggestion because only with the support on many can we deem it to have popular support and we are willing to co-operate,” she told reporters after attending a programme in Malacca yesterday.
Rohani was further quoted as saying that shorter working hours may not necessarily affect productivity as government workers could still continue to work from home.
“What is most important is that the job is done while the quality of work is not compromised. One example are translators. The don’t really have to be in office to do their job,” she said.
MTUC secretary-general N. Gopal Kisham recently asked the government to consider reducing the current eight working hours to just six for its workers.
Chief Secretary Tan Sri Ali Hamsa in response said the government was willing to consider the proposal, Utusan reported.
Rohani noted her ministry has already implemented a flexible working hour system for married civil servants with children two years ago.
Malaysia has over 1.6 million workers in the civil service, among the largest in the region. Their wages are the single biggest expenditure item on the federal budget.

MALAYSIA:::Buck up, Indian and mamak eateries told

PETALING JAYA: Indian and mamak restaurants must offer better wages and improve working conditions if they want to attract local employees, says the Malaysian Trades Union Congress (MTUC).
MTUC Secretary-General N Gopal Krishnam told FMT the problem was not that locals did not want to work at such jobs, but that the wages and working conditions were not appealing.
He was commenting on MIC President S Subramaniam’s recent revelation that many Indian restaurants were closing down due to a shortage of workers, brought about by the freeze on foreign labour.

KUALA LUMPUR: Sudah tiba masa untuk Malaysia mempertimbangkan cadangan untuk mengurangkan waktu bekerja dalam sehari.

Kongres Kesatuan Sekerja Malaysia (MTUC) berpendapat waktu bekerja selama 48 jam seminggu yang diperuntukkan di bawah undang-undang adalah terlalu 'lama' berbanding negara-negara yang lain.

Setiausaha Agungnya N. Gopal Kishnam berkata pengamalan waktu bekerja yang panjang akan memberi kesan buruk kepada pekerja dalam jangka masa yang lama dan akhirnya mengurangkan produktiviti.
